1. OVERVIEW
These Terms and Conditions apply to all services and products provided by The Black and White Box Ltd (“we”, “our”, “us”) to individual consumers (“you”, “your”). By placing an order in-store or online, you agree to these Terms.
2. SERVICES OFFERED
We provide custom photographic services including film processing, scanning, printing, and framing. Each order is bespoke and begins only after confirmation and/or payment is received.
3. PAYMENT
3.1. We offer two payment structures depending on the type of service or product:
For the purchase of goods, 100% payment is required upfront.
For services, a minimum 50% deposit is required to begin the job, with the remaining 50% due upon completion.
You will be notified at the time of booking or quoting which payment option applies to your order.
3.2. We accept payment via Eftpos, credit card, and online payment platforms.
4. TURNAROUND TIMES
4.1. Estimated turnaround times are listed on our website. These are indicative only and may vary due to workload, holidays, or unforeseen circumstances. Please visit this webpage for further information.
4.2. Rush orders are available at an additional fee, subject to approval.
5. CUSTOMER SUPPLIED MATERIALS
5.1. We take care when handling your film, prints, or digital media, but accept no liability for loss or damage unless caused by our negligence.
5.2. You should retain digital copies or negatives where possible. Please advise staff if the materials are irreplaceable.
6. STORAGE & FILE RETENTION
6.1. Digital files (e.g., scans or print files) are stored for 6 months unless otherwise agreed.
6.2. After that period, files may be deleted without notice. We recommend you download your files promptly after receiving the link or USB.
6.3. Unclaimed film, negatives, artwork, goods, finished work, or other materials will be destroyed after one year.
7. REFUNDS & RETURNS
7.1. Due to the custom nature of our services, refunds are only provided if the service is not completed as described or contains a fault (as per the Consumer Guarantees act 1993).
7.2. We do not offer refunds for change of mind once production has started.
7.3. Blank Roll Policy: If a roll of film is determined to be blank with zero exposures (i.e. unexposed or fogged), we will issue a store credit for the value of the scanning portion of the fee. The development portion is non-refundable, as it covers the irreversible cost we incur to determine whether the film has images.
8. LIABILITY
8.1. Our liability is limited to the cost of redoing the service or refunding the original fee paid.
8.2. We are not liable for indirect or consequential loss (e.g. re-shoots, missed deadlines).
8.3. We exercise utmost care in handling film, developed negatives and transparencies, and all other materials entrusted to us. However, in the event of unforeseen loss or damage within our lab, reimbursement will be limited to the material value of the items affected.
8.4. Submitting film or artwork to us constitutes your agreement that any damage or loss caused by us, even if through negligence or fault, will entitle you only to replacement with a like amount of unexposed film and equivalent processing services. Except for such replacement, acceptance of materials is without any other warranty or liability, expressed or implied other than as required by the Consumer Guarantees act 1993.
8.5. We accept no liability for materials lost in the post or by commercial courier services.
9. COPYRIGHT & USAGE
9.1. You retain copyright over your images.
9.2. By submitting materials for processing or printing, you confirm that you have the legal rights to do so.
9.3. We will never use your images in promotional material without your explicit permission.
10. CONSUMER GUARANTEES ACT
10.1. All services and goods are subject to the Consumer Guarantees Act 1993. These rights are in addition to those set out in this agreement.
11. GENERAL
11.1. These Terms are governed by the laws of New Zealand.
11.2. We reserve the right to update or amend these Terms at any time. The latest version will be available on our website.
